Timmendequas had a history of abusing young girls. In response, New Jersey passed Megan’s Law in 1994. This law said that people who had been guilty of a crime had to file with the police and give personal information like their names, addresses, and the types of crimes they had committed.

Online records made this knowledge available to everyone. Pennsylvania did the same thing and passed its own law in 1996. Over time, the law has been changed to make it better at stopping sex crimes. Offenders now have to update their register every so often, and how often depends on how bad the crime was.

Megans Law PA requires people who have been convicted of sexual crimes against children or other major sexual crimes to be registered. People who have been accused of rape, severe lewd attack, child abuse, and other sexual crimes must follow the law.

The goal of the law is to provide law enforcement and the public with necessary information about the whereabouts of these offenders, enabling citizens to take precautions to protect themselves and their children.

By law, sex offenders must register with the Pennsylvania State Police. The Pennsylvania State Police keeps a record for criminals that anyone can view. The list has information like the following:

  • The full name of the criminal
  • Address and stories of living places
  • Details about the crime that was committed
  • A picture of the criminal
  • The criminal’s physical traits, such as their height, weight, and other factors that make them stand out

Offenders must also keep their information up to date on a regular basis, which depends on the type of crime they committed and how long they are needed to stay registered.

People may have to register for 10 years, 25 years, or even life, depending on the crime. People who are found guilty of the worst crimes, like sexual abuse of a child, have to stay on the list forever and can’t get off of it.

The type of crime a person has committed determines what tier level they are given. Here is a list of the classifications and major crimes that go with each level:

Tier I – Low-Risk Offenders

Offenders in Tier I are thought to be low risk, which means they probably won’t break the law again. People who break this area of the law have to register for 15 years. Law enforcement organizations are told about their state, but most of the time, the public is not told about them. Tier I offences include the following:

  • Force and Persuasion
  • Corruption of Young People
  • Not letting people in
  • Trying to get a child into a car or building
  • Domain names that lead people astray on the Internet

Tier II – Moderate-Risk Offenders

Tier II criminals are thought to have a modest chance of committing another crime. They have to sign up for 25 years. Child care places, schools, daycares, and camps for kids are also told about a person’s Tier II situation, along with the police. These are some important crimes for Tier II:

  • Having sexual contact that is harmful

Tier III – High-Risk Offenders

  • Abusive sexual contact and assault on a child (under 13 years old)
  • Rape
  • Incest

Changes in the Law: From Megan’s Law to Act 10 and Act 29

Act 10 (2012)

A law called Act 10 was passed in 2012 to make Pennsylvania’s registration rules match those of the Sex Offender Registration and Notification Act (SORNA). This is a federal law that made registration rules for sex offenders more consistent across the US.

Act 10 made the rules tighter, giving criminals longer amounts of time to register and more frequent changes to their personal information. The goal was to make the public safer by giving police and the public the most up-to-date information on sex criminals.

Legal Challenges to Act 10

Act 10 tried to make the law better, but there were big issues with it. In 2017, the Pennsylvania Supreme Court said that some parts of Act 10 were illegal. Changes were made to the register system after the court said that some parts of the law violated the rights of criminals.

Act 29 (2018)

Act 29 was passed in 2018 in reaction to the court’s decision. This new law changed the standards for registering and set up a tiered system for criminals, putting them into groups based on how bad their crimes were.

This method decided how long someone had to be registered, with longer registration times needed for more major offences. Act 29 also gave people who had been guilty of a crime before Act 10 was passed a way to question their registration requirements.
